Design means only the features of shape, configuration, pattern or ornament or composition of lines or color or combination thereof applied to any article whether two dimensional or three dimensional or in both forms

Designs Act, 2000 provides registration of designs for a limited period to stop others from making, using or selling the product without their permission.

Essential requirements for the registration of 'Design' under the Designs Act, 2000

he design should be new or original, not previously published or used in any country before the date of application for registration. The novelty may reside in the application of a known shape or pattern to new subject matter.

The design should relate to features of shape, configuration, pattern or ornamentation applied or applicable to an article.

Duration of the Registration

The duration of the registration of a design is initially ten years from the date of from the priority date.

A Patent is a legal monopoly, which is granted for a limited time by a country to the owner of an invention.

Essential requirements for the registration of ' PATENT ' under the Patents (Amendment) Act 2005

Geographical Indications

Geographical indications are…indications, which identify a good as originating in the territory…or a region or locality in a territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin." It can also be defined as a sign used on goods that have a specific geographical origin and possess qualities or a reputation that is due to that place of origin. Most commonly, a geographical indication consists of the name of the place of origin of the goods. For example, Msyore Silk, Channapatna Toys, Kancheepuram Sarees, Darjelling Tea, Mysore Sandal Soap, Dharwad Peda, Kullu Shawl etc.
